We/I the undersigned acknowledge and agree that the services provided by Tracker Pipeline and Utility Locating Inc (“Tracker”) are not intended to replace contacting Alberta One Call and that locating pipelines and other buried facilities is a complex task and that Tracker may encounter a lost signal, field distortion, ghosts, depth wandering, differing soil types ands other difficulties that prevents it from locating a buried facility.
In light of the foregoing, the Undersigned hereby releases and agrees to indemnify Tracker, to the greatest extent permissible by law, from any and all liability (including but not limited to liability, claims, suits or actions for loss or damages concerning property damage, damage to a third party or third party property, personal injuries, including death, or any other loss or damage whatsoever) arising from work done and services provided by Tracker notwithstanding that such loss or damage is caused by a breach of contract by Tracker, on account of Tracker’s negligence, including gross negligence, or as a result of a duty of care prescribed by common law or legislation, or otherwise.
*Tracker Locating cannot locate non-metallic pipes.
